Small Business Tipping Fee Waiver Program
This program is for small businesses seeking a landfill tip fee waiver for construction and demolition debris material. Funding awards are provided through a Tipping Fee allocation available to the Broome County Land Bank through Broome County’s budget. Applications will be accepted on a rolling basis throughout the year contingent on funds available.
The Broome County Land Bank Small Business Tip Fee Waiver Program requires the following:
- Applicant(s) must operate a small business, which is defined as having less than 50 employees, in order to be eligible to apply.
- Applicant(s) must demonstrate that the project is consistent with the Land Bank’s mission and goals.
- Funding awards are capped at $15,000 per application.
- Only one application per applicant may be considered at one time. Multiple submissions at one time will not be considered.
- An awarded applicant may submit further applications at a later date; however, preference may be granted to other applicants who have not previously received a waiver by the Land Bank Board under this program.
- In order for an application to be considered, it must be submitted a minimum of 10 business days prior to a Land Bank Board of Directors meeting. Any submissions after that time will not be considered by the Board until the following month’s meeting.
- Any demolition project cannot commence until at least one week following Board approval, in order to coordinate and approve all paperwork between the applicant, the Land Bank, and the Broome County Landfill.
- Proposed demolition projects must be completed within 90 days of an executed agreement.
- The Executive Director is empowered to extend this up to an additional 30 days.
- Any extension greater than 30 days must be considered by the Land Bank Board of Directors.
- Documentation for the extension, as to the reason for the delay, must be provided to the Executive Director prior to consideration and/or granting an extension.
- Redevelopment plans must be submitted to the Land Bank within one-year (12 months) of an executed agreement.
- The Executive Director is empowered to extend this up to an additional 60 days.
- Any extension greater than 60 days must be considered by the Land Bank Board of Directors.
- Documentation for the extension, as to the reason for the delay, must be provided to the Executive Director prior to consideration and/or granting an extension.
- Applicant will commence and complete the development of the property in accordance with the plan presented to the Land Bank within three (3) years of an executed agreement.
- The Executive Director is empowered to extend this up to an additional 90 days.
Any extension greater than 90 days must be considered by the Land Bank Board of Directors. - Documentation for the extension, as to the reason for the delay, must be provided to the Executive Director prior to consideration and/or granting an extension.
- If the applicant fails to meet the deadlines, the Land Bank reserves the right to recapture the total amount of the tipping fee waiver credits from the applicant. The value of the credits is to be determined solely and exclusively by the County of Broome.
- If an awarded applicant sells or transfers ownership of any property which has received tipping fee waiver credits under this program, the original applicant is still responsible for these goals to be met, or the Land Bank reserves the right to recapture the total amount of the waiver from the applicant.
- Prior to demolition, if the property has been structurally condemned, the condemnation notice shall be provided to the Land Bank. If the property has not been structurally condemned, pre-demolition asbestos surveys and proof of any required abatement shall be provided to the Land Bank.
Land Bank staff will review all applications received and make recommendations to the full Board of Directors. The Land Bank retains the right to deny funding to any and all projects.
